Most divorce/marital dissolution cases begin with a Petition for Dissolution filed by one of the spouses.  From there, a court hearing may be necessary to establish child custody, child support, or spousal support orders.  Sometimes, restraining orders are needed if there is an abusive situation and one of the spouses has to be stopped from harassing or abusing the other, or the children.  It is always preferable to achieve some settlement, but if this cannot be done, a bench trial in front of a judge may be necessary to effect permanent orders regarding custody or the division of marital assets.
